M&R Collective Terms of Service

Overview

This website is operated by M&R Collective.

Throughout the site, the terms “we”, “us” and “our” refer to M&R Collective.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services to you.

By visiting our website, purchasing a product from us, or otherwise using our website, you agree to these Terms of Service and any other policies referenced on our website.

Please read these Terms carefully before using the website or placing an order.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights available under the Australian Consumer Law.

1. Online Store

By using this website, you agree to use it only for lawful purposes.

You must not use our products, website or services for any unlawful or unauthorised purpose, or attempt to interfere with the security or normal operation of the website.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • We reasonably suspect fraud or unauthorised payment activity

  • An obvious pricing or product-listing error has occurred

  • A product becomes unavailable

  • Incorrect customer or delivery information has been supplied

  • An order breaches these Terms or applicable law

If we cancel an order after payment has been successfully received and no goods are supplied, an appropriate refund will be issued.

2. Products

We make reasonable efforts to display product photographs, colours, descriptions and specifications as accurately as possible.

However, colours may appear slightly different depending on the customer's screen, device or display settings.

Some M&R Collective apparel and merchandise is produced specifically to order using print-on-demand fulfilment services.

As a result, minor variations in print placement, positioning or colour may occur between production runs where these variations do not constitute a product defect or failure to meet applicable consumer guarantees.

Product availability may change without notice.

3. Print-on-Demand Production

Many M&R Collective apparel products are produced after an order is placed through our Australian print-on-demand production and fulfilment partners.

When you purchase these products, M&R Collective remains responsible for your order and is your point of contact for customer service.

Our production or fulfilment partners may manufacture, package and dispatch products directly to you on our behalf.

Production times are separate from shipping and delivery times.

Because print-on-demand products are manufactured specifically for individual orders, customers should carefully check their selected design, garment, colour and size before completing their purchase.

4. Prices

Unless otherwise stated, prices displayed on the M&R Collective Australian storefront are shown in Australian dollars (AUD).

Prices may change from time to time without notice.

Any price change will not affect an order that has already been accepted and paid for, except where an obvious pricing error has occurred and it would be unreasonable for the listed price to be honoured.

Taxes and shipping charges, where applicable, will be displayed during checkout.

For customers shopping through international markets, prices may be displayed in another currency depending on location and Shopify market settings.

5. Orders and Payment

An order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfilment.

You agree to provide current, complete and accurate information when placing an order.

You are responsible for checking:

  • Product selection

  • Design

  • Size

  • Colour

  • Quantity

  • Delivery address

  • Contact information

before submitting your order.

If you notice an error after placing an order, please contact us as soon as possible.

Because print-on-demand orders may enter production shortly after purchase, we cannot guarantee that changes or cancellations can be made after production has begun.

6. Shipping and Delivery

Estimated production and delivery times displayed on our website are estimates only unless expressly stated otherwise.

Delivery times may be affected by circumstances outside our reasonable control, including postal or courier delays, severe weather, public holidays, customs processing or disruptions to transport networks.

Customers are responsible for supplying a complete and accurate delivery address.

7. Returns, Refunds and Consumer Guarantees

Our Return & Refund Policy forms part of these Terms.

Nothing in these Terms or our Return & Refund Policy excludes, restricts or modifies rights available under the Australian Consumer Law.

Our goods come with consumer guarantees that cannot be excluded under Australian law.

Depending on the circumstances, if a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy.

Change-of-mind returns are dealt with separately under our Return & Refund Policy.

8. Product Sizing

Garment measurements and sizing information may vary between different brands and garment styles.

Customers should review the size guide associated with the relevant product before ordering.

Where the correct size ordered by the customer has been supplied, selecting an unsuitable size does not necessarily mean the product is faulty.

This does not affect your rights where the wrong size was supplied, the product was incorrectly described or an applicable consumer guarantee has not been met.

9. Promotions and Discount Codes

Discount codes and promotional offers may be subject to additional conditions.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash

  • Only one discount code may be used per order

  • Discounts cannot generally be applied retrospectively to completed purchases

  • Promotional offers may have expiry dates or eligibility requirements

  • We may withdraw or amend a promotion before an order is placed

We reserve the right to cancel or refuse the use of promotional codes where they have been used fraudulently, unlawfully or contrary to the stated promotional conditions.

10. Intellectual Property

Unless otherwise stated, artwork, designs, graphics, logos, branding, photographs, written content and other material created by or for M&R Collective remain the intellectual property of M&R Collective or the relevant rights holder.

Purchasing a product containing an M&R Collective design does not transfer ownership or intellectual-property rights in that design to the purchaser.

You must not reproduce, commercially distribute, modify, sell or otherwise commercially exploit our designs, branding or content without permission.

Third-party names, trademarks and intellectual property remain the property of their respective owners.

11. User Content

If you send us photographs, reviews, messages, design requests or other material, you retain any rights you hold in that material.

We will not claim ownership of your content merely because it has been submitted to us.

Where we wish to use customer photographs, reviews or other submitted content for promotional or marketing purposes beyond what is reasonably necessary to provide customer service, we may seek appropriate permission where required.

12. Custom and Personalised Orders

For personalised or custom products, you are responsible for reviewing names, wording, spelling and other custom information supplied to us.

Once a custom product has entered production, changes may no longer be possible.

A customer-supplied spelling or design error does not necessarily constitute a manufacturing defect.

This does not affect your rights where the final product does not match the approved order or otherwise fails to meet an applicable consumer guarantee.

13. Third-Party Services

Our website may use third-party services including Shopify, payment providers, shipping carriers, fulfilment providers and other technology services.

These providers may process information or provide parts of the service necessary to complete your transaction.

Some links on our website may direct you to third-party websites.

We are not responsible for the independent content, privacy practices or terms of third-party websites that we do not control.

14. Website Availability

We aim to keep our website available and functioning correctly but cannot guarantee uninterrupted or error-free access.

We may modify, suspend or discontinue parts of the website where reasonably necessary for maintenance, updates, security or operational reasons.

15. Errors and Inaccuracies

Occasionally information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, availability or other information.

We reserve the right to correct genuine errors and update information.

Where an error materially affects an order that has already been placed, we will contact the customer where reasonably practicable and provide an appropriate solution.

16. Limitation of Liability

To the maximum extent permitted by law, M&R Collective is not liable for losses that were not reasonably foreseeable or that arise from misuse of our website or products.

Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited, including liability arising under the Australian Consumer Law.

Your personal information is handled in accordance with our Privacy Policy.

Our store is hosted by Shopify, and Shopify and other service providers may process information when you browse our website or make purchases in order to provide ecommerce, payment, security, analytics and related services.

18. Changes to These Terms

We may update these Terms of Service from time to time.

The version published on our website at the time an order is placed will generally apply to that transaction.

Material changes will apply prospectively unless otherwise required by law.

19. Governing Law

These Terms are governed by the laws applicable in South Australia, Australia, and applicable Commonwealth laws.

Nothing in these Terms limits any rights you may have under mandatory laws applying in another Australian state or territory or, where applicable, consumer-protection laws applying to international customers.
